Is the information you want personal data? Personal information may be exempt from disclosure under the Freedom of Information Act or Data Protection Act. The Data Protection Act allows access to personal information but it specifically refers to ‘your’ personal information and does not allow access to someone else’s personal information If your request is for information about yourself you should make a Subject Access Request under the Data Protection Act. Under the Freedom of Information Act, we must reply to your request within 20 working days. Under the Data Protection Act, we must reply to your request within 40 calendar days. Will Companies House always provide me with the information I request? Information must be disclosed unless there is a good legal reason not to. If we refuse to give you information then we must explain why. Some information may be exempt under the Freedom of Information Act or Data Protection for a number of reasons. Under data protection, most organisations are allowed to charge a maximum of £10. Under freedom of information, in most cases the information will be provided free, but some costs, such as photocopying and postage, can be charged for. You will be notified if there is a charge. Information that Companies House already makes available through its products and services may be chargeable. Complaints about responses provided by the Information Rights Team Anyone not happy with the response to their request can make a complaint or request a review of our response, by writing to the Information Rights Team, within two calendar months of the date of the response. The review will be conducted by a senior member of Companies House who has had no previous involvement with the case. If you are then not content with the outcome of your complaint, you may apply directly to the Information Commissioners Office (ICO), who enforces and oversees the Freedom of Information and Data Protection Acts, for a decision. Generally, the ICO cannot make a decision unless you have exhausted the complaints procedure provided by us.
